General Terms and Conditions

These terms apply to purchases made through the ROMAIN website by consumers. Mandatory consumer rights always prevail over any conflicting provision.

1. Scope and acceptance

These General Terms and Conditions apply to products and, where relevant, services offered by ROMAIN B.V. through this website. Before placing an order, the customer must be able to read, save and accept these terms.

A customer who purchases mainly for purposes outside a trade, business, craft or profession is a consumer. Nothing in these terms limits rights that consumers cannot waive under Belgian or applicable European law.

2. Product information, availability and prices

ROMAIN aims to describe products, essential characteristics, availability and images as accurately as reasonably possible. Minor differences in colour or presentation caused by screens or photography do not constitute non-conformity.

Prices are shown in euros and include applicable taxes unless the checkout clearly states otherwise. Delivery charges and any other unavoidable costs are shown before the customer confirms the order. ROMAIN does not charge a payment surcharge unless this is expressly permitted by law and clearly disclosed before purchase.

If an obvious pricing, stock or technical error occurs, ROMAIN will promptly contact the customer. ROMAIN may cancel the affected order and refund all sums paid, or invite the customer to confirm the order at the correct price. This does not affect statutory rights.

3. Orders, contract formation and payment

The customer must provide complete and accurate information. An order is an offer to purchase. The contract is concluded when ROMAIN sends an order confirmation by email, unless that message clearly states that it is only an acknowledgement of receipt.

ROMAIN may refuse or cancel an order on objective grounds, including suspected fraud, unlawful resale, a payment failure, an obvious error, unavailability or an incomplete checkout. Any amount already received for a cancelled order will be refunded without undue delay.

Payment is processed using the methods and payment service provider displayed at checkout. Products remain the property of ROMAIN until full payment, without affecting the transfer-of-risk rules for consumers.

4. Delivery, shipping and transfer of risk

Available delivery areas, shipping options, estimated timeframes and costs are shown at checkout. Unless another delivery period is expressly agreed, ROMAIN will deliver without undue delay and no later than 30 days after conclusion of the contract.

Estimated delivery dates are not guaranteed unless ROMAIN expressly agrees that a date is essential. If delivery is delayed, the consumer may grant ROMAIN a reasonable additional period. If ROMAIN still does not deliver within that period, the consumer may terminate the contract and receive the refund required by law. An additional period is not required where ROMAIN refuses delivery or where timely delivery was expressly essential.

Where ROMAIN appoints the carrier, the risk of loss or damage remains with ROMAIN until the customer, or a third party designated by the customer other than the carrier, takes physical possession. If the customer independently appoints a carrier not offered by ROMAIN, risk may pass when the goods are handed to that carrier, as permitted by law.

5. Postal or carrier problems, wrong addresses and uncollected parcels
Important: ROMAIN cannot exclude the statutory delivery rights of consumers when a carrier selected by ROMAIN loses or damages a parcel before delivery.

Carrier delays outside ROMAIN's reasonable control may extend an estimated delivery date, but do not remove mandatory consumer remedies. Customers should report missing, delayed or damaged parcels promptly so ROMAIN can investigate with the carrier.

No refund of shipping charges, and no free replacement or re-shipment, is available where delivery fails because the customer supplied an incomplete or incorrect address, refused delivery, failed to collect the parcel within the carrier's collection period, or otherwise caused the failed delivery. In those cases, the customer may be charged the actual return and re-shipment costs. If the goods are returned to ROMAIN, any refund for the goods will be handled in accordance with mandatory withdrawal and consumer law, and ROMAIN may deduct amounts it is legally entitled to retain.

A delay or inconvenience caused by the postal operator does not by itself create an immediate refund right before the agreed or statutory delivery period, and any legally required additional delivery period, has expired. This clause does not affect rights relating to goods lost or damaged before delivery, the legal guarantee, or any other mandatory consumer right.

6. Right of withdrawal for online purchases

Unless a statutory exception applies, a consumer may withdraw from an online purchase without giving a reason within 14 days. For goods, the period starts on the day after the consumer or a designated third party other than the carrier receives the goods. For multiple goods delivered separately, it starts after receipt of the last good.

To withdraw, the consumer must send an unambiguous statement before the deadline to info@romainghent.be or ROMAIN B.V., Verbroederingstraat 19, 9050 Gentbrugge, Belgium. The model form at the end of these terms may be used but is not compulsory.

The consumer must return the goods no later than 14 days after notifying ROMAIN. Unless ROMAIN agrees otherwise, the direct return cost is paid by the consumer. Goods should be securely packed and returned to the address above. A traceable shipping method is recommended.

The consumer may inspect the goods as they would in a shop. The consumer is responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

7. Exceptions to the right of withdrawal

The right of withdrawal does not apply where a statutory exception applies, including:

  • Goods made to the customer's specifications or clearly personalised.
  • Goods liable to deteriorate or expire rapidly.
  • Sealed goods that are genuinely unsuitable for return for health protection or hygiene reasons after the seal has been broken.
  • Services fully performed during the withdrawal period, where performance began with the consumer's prior express request and acknowledgement that the right would be lost after full performance.
  • Digital content not supplied on a tangible medium, once performance has begun with the consumer's prior express consent and acknowledgement of losing the withdrawal right, where all legal conditions are met.
  • Leisure services to be performed on a specific date or during a specific period, where the statutory exception applies.

Exceptions are interpreted narrowly. Opening ordinary transport packaging does not automatically remove the withdrawal right.

8. Refunds following withdrawal

ROMAIN will refund payments covered by a valid withdrawal, including the cost of the least expensive standard delivery method offered, no later than 14 days after receiving the withdrawal notice. ROMAIN may withhold reimbursement until the goods are received back or the consumer provides evidence of return, whichever occurs first.

Additional delivery costs resulting from the consumer choosing a more expensive method than standard delivery are not refunded. Refunds are made using the original payment method unless another method is expressly agreed and does not create costs for the consumer.

9. Legal guarantee and defective goods

Consumers benefit from the Belgian legal guarantee of conformity. For new consumer goods, ROMAIN is liable for a lack of conformity that appears within two years after delivery, subject to applicable law.

The consumer should notify ROMAIN as soon as reasonably possible after discovering a defect and provide the order number, a description and, where useful, photographs. The legal seller - ROMAIN - handles the statutory guarantee; any manufacturer's warranty is additional and does not replace it.

Depending on the legal conditions, the consumer may be entitled to repair or replacement free of charge and, where the statutory requirements are met, an appropriate price reduction or termination and refund. Return costs for goods validly claimed to be non-conforming are borne as required by law.

10. Appointments, cancellations and no-shows

Appointment-specific cancellation terms, including any permitted no-show fee, must be shown in the booking flow before the appointment is confirmed. Customers should cancel or reschedule within the period stated in that booking policy.

If a customer does not attend without timely notice, ROMAIN may charge a reasonable fee reflecting the reserved time and the loss actually suffered, to the extent permitted by law and disclosed before booking. ROMAIN will take reasonable steps to limit its loss. Mandatory consumer rights remain unaffected.

11. Tobacco products

ROMAIN does not sell, offer, advertise, reserve or accept online payment for tobacco products or similar regulated products through this website. Belgian law prohibits online sale and purchase of tobacco products and broadly prohibits tobacco advertising.

Any legally permitted in-store sale is strictly limited to persons aged 18 or over. ROMAIN must request proof of age from customers who appear younger than 25 and will refuse the sale where age cannot be verified. Products remain out of sight and are shown only where legally permitted at the explicit request of an adult customer.

12. Force majeure and liability

ROMAIN is not liable for delay or failure caused by an event beyond its reasonable control, provided it informs the customer where appropriate and takes reasonable steps to limit the impact. Obligations are suspended only for the duration and extent of the event. Mandatory delivery, refund and termination rights remain unaffected.

Nothing in these terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights. Subject to those rules, ROMAIN is not liable for indirect or unforeseeable loss not caused by a breach by ROMAIN.

13. Intellectual property and external links

Website content, branding, trade names, logos, text, photographs, graphics and designs are protected by intellectual property rights belonging to ROMAIN or its licensors. They may not be copied, distributed or commercially used without prior permission, except where permitted by law.

External links are provided for convenience. ROMAIN does not control third-party websites and is not responsible for their content, privacy practices or availability. This does not exclude liability where exclusion is prohibited by law.

14. Complaints and consumer mediation

Questions or complaints can be sent to info@romainghent.be . Include the order number and a clear description. ROMAIN aims to acknowledge complaints promptly and provide a substantive response within a reasonable period.

15. Governing law, competent courts and severability

Belgian law applies, without depriving consumers resident in another country of mandatory protection granted by the law applicable to them. Disputes are submitted to the courts having jurisdiction under mandatory Belgian and European rules. Consumers retain the right to bring proceedings before any court made available to them by mandatory law.

If any provision is invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be interpreted or replaced only to the minimum extent needed to make it lawful while preserving its purpose.

16. Changes and language

The version accepted when an order is placed applies to that order. ROMAIN may update these terms prospectively for legal, technical or operational reasons. Updated terms will display a new revision date and will not retroactively reduce existing consumer rights.

These terms are provided in English. Where another language version is offered, customers will be informed which version governs, subject always to mandatory consumer law and the requirement that contractual information be clear and understandable.

This notice explains how ROMAIN B.V. processes personal data when people visit the website, contact ROMAIN, make a booking or purchase through the online store.

ROMAIN does not use solely automated decisions that produce legal or similarly significant effects unless this is separately disclosed and legally permitted.

3. How data is collected

Data is collected directly when a person places an order, books an appointment, creates an account, subscribes, contacts ROMAIN or exercises a right. Technical data may be generated when the website is used. ROMAIN may also receive relevant information from payment providers, booking tools, delivery partners, fraud-prevention services and other service providers.

Required fields are identified at the time of collection. If information required to enter into or perform a contract is not provided, ROMAIN may be unable to process the order, booking or request.

4. Recipients and processors

Personal data is shared only where necessary with categories of recipients such as:

  • Website, ecommerce, hosting and cloud providers.
  • Booking, CRM, customer-support and email providers.
  • Payment and fraud-prevention providers.
  • Delivery and logistics partners.
  • Professional advisers, insurers, auditors and accountants.
  • Public authorities where disclosure is legally required.
  • A purchaser or successor in a lawful corporate transaction, subject to appropriate safeguards.

Processors act under contractual instructions and must protect confidentiality and security. ROMAIN does not sell personal data.

5. International transfers

Some service providers may process data outside the European Economic Area. Where this happens, ROMAIN relies on a lawful transfer mechanism, such as an adequacy decision, approved standard contractual clauses and, where required, supplementary safeguards. Information about the relevant safeguards may be requested using the privacy contact address.

6. Retention

ROMAIN keeps personal data only for as long as necessary for the stated purpose, including:

  • Order, invoice, tax and accounting records for the applicable statutory retention period.
  • Contract and complaint records for the period needed to perform the contract and establish, exercise or defend legal claims.
  • Customer-service enquiries generally for up to 24 months after closure, unless a longer period is justified.
  • Marketing data until consent is withdrawn, an objection is made or the data is no longer needed, subject to keeping a limited suppression record.
  • Cookie and analytics data for the periods stated in the active cookie settings or provider list.

Data may be retained longer where required by law, a dispute, fraud prevention, security or a lawful authority request.

7. Rights

Subject to the GDPR and applicable conditions, individuals may request access, correction, erasure, restriction, portability and objection. Where processing relies on consent, consent may be withdrawn at any time without affecting earlier lawful processing. Individuals have an unconditional right to object to direct marketing.

Requests can be sent electronically to info@romainghent.be . ROMAIN responds without undue delay and in principle within one month. For a complex request, that period may be extended by up to two additional months after notice within the first month.

ROMAIN applies proportionate technical and organisational measures designed to protect personal data against unauthorised access, alteration, loss or disclosure. No internet system can be guaranteed completely secure.
